1.0 INTRODUCTION
We, Get Set 4 Education, take the protection of your personal data very seriously and strictly adhere to the rules laid out by data protection laws and the UK General Data Protection Regulation (and the EU GDPR where applicable). This privacy notice gives you information on how we collect and process your personal data through your use of this site, any data you may provide if you contact us regarding our products and services and/or if you are a customer of ours or are employed by a customer. 2.0 WHY WE COLLECT YOUR PERSONAL INFORMATION
We collect your personal data for one of the following purposes:
- To manage communications between you and us and/or our relationship with you/your employer
- Where we need to perform the contract we have entered into with you
- To provide you with information you have requested or which we may feel may be of interest to you
- To ensure the safe operation of our website and to monitor the performance of our website
- For marketing and advertising purposes
3.0 LAWFUL BASIS OF PROCESSING INFORMATION
We only collect and use personal information about you when the law allows us to. Most commonly, we use it where:
- If the processing is necessary for the performance of a contract.
- If the processing is necessary for compliance with a legal obligation to which we are subject.
- If the processing in necessary for the purpose of the legitimate interest pursed by us or our partners.
Where legitimate interest is identified as a lawful basis, we will undertake a legitimate interest assessment which is a three-part test covering:
- The purpose test – to identify the legitimate interest
- Necessity test – to consider if the processing is necessary for the purpose identified
- Balancing test – considering the individual’s interests, rights or freedoms and whether these override the legitimate interests identified.
We do not typically rely on consent as the lawful basis for processing your personal data, but we may on occasion do so. Where we rely on consent we will obtain your active agreement to use your personal data for a specified purpose.
4.0 WHAT INFORMATION WE COLLECT AND WHERE FROM
We collect personal information from you, for example, if you register to our services. The categories of personal information that we may collect, store and use about you include:
- Identity data – Account holder name and title
- Contact data - telephone number, email address
- Technical data - IP address, login data, browser type, device ID and other technology on the devices you use to access our site/platform.
- Usage data - information about how you interact with and use our website and platform.
- Marketing and Communications data - your preferences in receiving marketing from us and our third parties and your communication preferences.
We do not directly collect data from children, however as set out in more detail at section 8 below, children’s data may be input into our platform if our customer chooses to do so. Where that is the case, we act only as a processor of such data. We primarily collect data directly from you/your interactions with us, or where it is provided directly by your employer. This will normally be when you contact us (whether bv our website or otherwise), where your employer enters into a contract with us and your data is required to provide our services/platform. We also collect data using automated technologies. As you interact with our website and/or platform, we will automatically collect technical and usage data. More detail about such automated technologies can be found at section 11 below.
5.0 HOW WE USE YOUR PERSONAL DATA
We process your personal data for the following purposes and on the following lawful basis:
- Provide services to our customers, and where they are your employers we process your personal data in our legitimate interests in efficiently and effectively providing those services. Such personal data will include identity and contact data. For example, we will need your identity and contact data to set up an account on our platform and we may from time to time need to be to contact you or respond to queries you have.
- To manage our relationship with you, such as notifying you of changes to our terms or privacy policy or dealing with complaints or queries. This will involve identity and contact data, and may also involve technical, usage or marketing data depending on the nature of the query. We process such information to comply with legal obligations and/or as it is necessary in our legitimate interests (i.e. to keep our records updated, manage our relationship with you and efficiently deal with queries/complaints).
- To administer and protect our business and website/platform (including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data). This may involve identity, contact, technical and/or usage data. This can be necessary for compliance with a legal obligation, otherwise it is necessary in our legitimate interests in running our business, provision of administration and IT services, network security, to prevent fraud and in the context of a business reorganisation or group restructuring exercise.
- To use data analytics to improve our website, products/services, customer relationships and experiences and to measure the effectiveness of our communications and marketing. This may involve technical and usage data and is necessary for our legitimate interests (to define types of customers for our products and services, to keep our website updated and relevant, to develop our business and to inform our marketing strategy).
6.0 HOW LONG WE KEEP INFORMATION FOR
We pride ourselves on ensuring that your personal data is only retained for the period that we need it for, or in accordance with laws, regulations and professional obligations that we are subject to. All personal information collect has a defined retention period, which is in-line with our retention policy. 7.0 SECURITY OF PERSONAL INFORMATION
We take the responsibility for protecting your privacy very seriously and we will ensure your data is secured in accordance with our obligations under the Data Protection laws. We have in place technical and organisational measures to ensure personal information is secured and to prevent your personal data from being accessed in an unauthorised way, altered or disclosed. We have in place a robust access control policy which limits access to your personal data to those employees, contractors and other third parties who only have a business need to know. The processing of your personal data will only take place subject to our instruction. We have policies and procedures to handle any potential data security breaches and data subjects, third parties and any applicable regulators will be notified where we are legally required to do so. We have ensured that all employees have had information security and data protection training. 8.0 CHILDREN'S INFORMATION
You (where you are a customer or work for a customer) may choose to upload children data onto our platform. Get Set 4 Education will only view/access this information based on your request. If you would like more information on this, please contact us using the details in section 15 and/or 16.
9.0 YOUR INDIVIDUAL RIGHTS
In this Section, we have summarised the rights that you have under UK GDPR (and/or EU GDPR where applicable). Some of the rights are complex, and not all the details have been included in our summaries. Accordingly, you should read the relevant laws and guidance from the regulatory authorities for a full explanation of these rights. Your principal rights under General Data Protection Regulation are set out below:
- Request access to your personal data (commonly known as a "subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it. We may need to verify your identity as part of such a request.
- Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
- Request erasure of your personal data in certain circumstances. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
- Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) as the legal basis for that particular use of your data (including carrying out profiling based on our legitimate interests). In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your right to object. You also have the absolute right to object any time to the processing of your personal data for direct marketing purposes.
- Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
- Withdraw consent at any time where we are relying on consent to process your personal data (as set out above, this will not normally apply). However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
- Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in one of the following scenarios: If you want us to establish the data's accuracy;
- Where our use of the data is unlawful but you do not want us to erase it;
- Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims;
- You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

10.0 FAILURE TO PROVIDE PERSONAL INFORMATION
Where we need to collect personal data by law or in order to process your instructions or perform a contract we have with you and you fail to provide that data when requested, we may not be able to carry out your instructions or perform the contract we have or are trying to enter into with you. In this case, we may have to cancel our engagement or contract you have with us, but we will notify you if this is the case at the time.

12.0 AUTOMATED DECISION MAKING
Your personal data is not used in any automated decision making (a decision made solely by automated means without any human involvement) or profiling (automated processing of personal data to evaluate certain conditions about an individual).
13.0 TRANSFERS TO THIRD PARTIES
Get Set 4 Education may disclose your personal data, listed in section 4 to some third parties to help us deliver our services/products. All third parties are contractually bound to protect the personal data we provide to them. We may use several or all of the following categories of recipients:
- Business partners, suppliers, contractors for the performance of any contract we enter into with them or you. Third parties that support us to provide products and services e.g. IT support, cloud-based software services, providers of telecommunications equipment, virtual personal assistants)
- Marketing services providers
- Payment service providers
- Recruitment service providers
- Professional advisors e.g. lawyers, auditors
- Web analytics and search engine provider to ensure the continued improvement and optimisation of our website.
- Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets.
Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.
14.0 TRANSFERS OUTSIDE OF THE EEA
In this section, we provide information about the circumstances in which your personal data may be transferred and stored in countries outside the UK. Where personal data is transferred outside of the UK, it will primarily only be transferred within the EEA. In such circumstances we rely on the adequacy decision that is in place, which means your data will still be afforded the same level of protection when transferred into, or within, the EEA as it does in the UK.
In limited circumstances personal data may be accessed within our systems by selected suppliers who are based outside of the EEA. The data itself is not transferred, in the ordinary sense, to those suppliers but they have access to our systems in order to provide their services. This typically means having access to account holder information (identity and contact data) in order to provide their services, which are typically administrative assistance services. We do not transfer or permit access to any children’s personal data we may process (see section 8 above for information on this point) outside of the EEA. Any personal information transferred outside of the EEA will only be processed on our instruction and we ensure that information security at the highest standard would be used to protect any personal information as required by the Data Protection laws. Where personal data is transferred outside of the EEA we will only do so to a country with an adequacy decision or where we have ensured appropriate safeguards are in place (this will usually mean we have entered into standard contractual agreements with the relevant supplier in a form approved by data protection regulators) For more information about transfers and safeguarding measures, please contact us using the information in section 16.
15.0 RIGHT TO COMPLAIN
We take any complaints about our collection and use of personal information very seriously. If you think that our collection or use of personal information is unfair, misleading, or inappropriate, or have any other concern about our data processing, please raise this with us in the first instance.
